Rental Terms
This English version is provided for convenience only. The German version (switch to DE at the top of the page) is legally binding.
The following Rental Terms apply:
§ 1 All prices are list prices per day of use and are quoted in euros plus statutory VAT. Prices are calculated individually, depending on the duration of the rental and the quantity of rented items. Individual price agreements such as cash discounts, special arrangements, flat rates, discounts or other price arrangements must be agreed in writing. Verbal side agreements are not valid. The binding rental price is only stated in the quote.
§ 2 The rental of the rented items begins when they leave our warehouse and ends on the day of return. If rented items are delivered out before 3 p.m. or returned after 10 a.m., the full daily rental rate will be charged. However, if a rental order confirmed in writing is not cancelled 24 hours before the specified delivery date, the full rent for the agreed rental period will be charged. Requested equipment is reserved for the renter for a period of 72 hours after the rental agreement/quote has been sent; we call this period the hold period. The renter automatically receives a right of first refusal. If the rental agreement/quote has not been confirmed in writing after 72 hours, the equipment is released again. Should another renter submit a rental inquiry during this hold period, the first renter will be informed. If the first renter does not exercise their right of first refusal, the new renter is awarded the booking.
§ 3 The rented items are handed over to the renter in perfect and clean condition. The renter is obliged to check all equipment for function and condition as well as for completeness according to the equipment list and their own requirements. Any defect in the rented items must be reported immediately to KNITTERFISCH (hereinafter referred to as the lessor). If the renter fails to comply with this inspection obligation, the lessor is no longer liable for damage due to defects in the rented items or for consequential damage. The renter must use the rented items in the manner prescribed by their intended purpose.
§ 4 The rented items are generally handed over during regular business hours. If a deviation from the pick-up times (Mon–Fri 10:00 a.m. to 6:00 p.m.) is requested, the lessor may charge additional costs as a result. These additional costs or service fees are agreed with the renter in advance and are not determined after pick-up. This applies to all pick-ups on weekdays before 10:00 a.m. and after 6:00 p.m., as well as all day on weekends and public holidays.
§ 5 The renter is prohibited from lending or subletting the rented items to third parties.
§ 6 Damage caused by improper use, malicious damage or misuse shall be borne by the renter. In such cases, the renter must replace the item(s) at their current value.
§ 6.1 The renter is obliged to inform the lessor of the intended purpose and the location of use of the rented items. Extraordinary or unusual circumstances and special types of filming must be pointed out.
§ 7 The lessor does not provide insurance for the rented items. The renter must store the items in such a way that theft is ruled out. Should items be lost as a result of theft, the renter must replace the item itself in the amount of its replacement value or reimburse the costs of a replacement.
§ 7.1 The renter is obliged to have insurance. The renter must be able to provide proof of an insurance policy that covers loss through theft and/or burglary as well as damage to and/or total loss of the rented items.
§ 8 The lessor undertakes to provide the ordered equipment. If provision is not possible for reasons for which the lessor is not responsible, or which fall within the lessor’s sphere of influence but were not brought about intentionally by the lessor, the lessor will endeavor to obtain a replacement as quickly as possible. If a replacement cannot be obtained in this way, however, further claims are excluded.
§ 9 In the event of a failure of rental equipment, the rental days lost will not be charged. The lessor will endeavor to provide a replacement as quickly as possible. However, further claims by the renter are excluded.
§ 10 The renter is liable for damage that falls within their sphere of influence. The renter is not liable for internal electronic damage to equipment that occurs through no fault of the renter.
§ 11 Drop damage / non-visible damage: Attention! Many of our devices are equipped with Shockwatches*. If these drop indicators show the color “red” upon return, we will send the device to the manufacturer for inspection (and repair if necessary). The renter bears all resulting costs in full (* ShockWatch clip impact indicators are tamper-proof devices that turn bright red to indicate drop damage. These impact indicators are mounted directly on our devices.)
§ 12 In the event of damage, the lessor reserves the right to claim the rent until a replacement has been obtained. This also includes any third-party rental that may be necessary. The lessor is obliged to arrange for the replacement as quickly as possible.
§ 13 After the last rental day, the equipment must be sent back or handed over to the lessor at the renter’s expense. Any extension of the rental period must be agreed with the lessor in advance. If rented items are kept longer without prior consultation, additional rental days will be charged depending on the duration. If rented items are not returned at the agreed time and a subsequent rental or an in-house production of the lessor is affected as a result, the resulting additional costs may be charged to the renter.
§ 14 The lessor carries out a function test after the return of the rented items. The renter may be present during this test on request. If the renter waives this joint inspection of the rented items upon return, any damage caused by the renter or claims for compensation by the lessor may be asserted up to 24 hours after return. This time limit does not apply to damage to a drop indicator (Shockwatch).
